ATTORNEY-CLIENT AGREEMENT THE LAW FIRM OF RICHARD GLEN BOIRE ONLINE SPECIAL - FELONY EXPUNGEMENT Attorney and Client hereby agree that Attorney will provide legal services to Client on the terms set forth below. 1. Purpose of Agreement: Client has informed Attorney that he or she has suffered a felony criminal conviction in a California state court. Client desires to have Attorney petition to reduce the conviction if eliguble under Penal Code section 17, and petition to expunge this conviction pursuant to Penal Code section 1203.4/1203.4a. Attorney himself or through Associate Counsel, agrees to prepare, file, and argue in Superior Court as necessary, the petition(s) described herein. 2. Client's Case Information: Client has informed Attorney that: A. Client was granted probation; B. Client successfully completed all terms & conditions of probation without any problems; C. Client has no current criminal charges or warrants pending; D. Client is not on probation for any offenses; E. Client owes no outstanding fines or fees, restitution, or traffic tickets. 3. Your Fee & What it Includes: Client's total fee to expunge a misdemeanor conviction is $795. The fees described in this paragraph include all Attorney's fees, all filing fees, all photocopy costs, all postage, all travel expenses, and include the cost of serving court papers on all necessary parties. All fees are earned upon receipt. 4. Additional Services: If client has more than one conviction under the same case number, Client agrees to pay Attorney an additional $595 to petition to expunge up to 4 additional counts of conviction. If Client's case is over 7 years old, or the court clerk is unable to provide Attorney with the necessary case information, Attorney may be required to obtain Client's official Criminal History Transcript from the California Department of Justice. If this becomes necessary, Client agrees to pay the cost (approx. $35.00) of obtaining his or her Criminal History Transcript and to promptly follow Attorney's instructions. 5. How Your Fee is Paid: Client must pay the full fee at the time this agreement is executed. 6. No Guarantees of Outcome Have Been Made: Attorney will use his best efforts, professional training, and experience on behalf of Client. Nothing in this Agreement and nothing in Attorney's statements to Client will be construed as a promise or guarantee about the outcome of the matter. Attorney's comments about the outcome of the matter are expressions of opinion only. Only a judge is empowered to grant an expungement. 7. Attorney - Client Confidentiality: By retaining Attorney under the terms of this agreement an Attorney-Client relationship is created, ensuring the confidentiality of all information Client shares with Attorney. We take your privacy extremely seriously. 8. Information about California Expungements Provided to Client: Client acknowledges that he or she has read and Attorney's "Information about California Expungements," which is incorporated into this agreement by reference and appended below. 9. Client Cooperation & Breach of Agreement: Client agrees to promptly provide all information requested by Attorney and to cooperate fully in providing Attorney with the information required to perform the professional legal services described in this agreement. If Client does not promptly respond to Attorney's requests for information, document reviews, signature, etc., Client will be deemed to be in material breach of contract. Client's breach of this agreement will also relieve Attorney of any and all further duties owed to Client. In addition, Client warrants that the information provided in Paragraph 2 above is accurate, and understands that Attorney is accepting Client's case at the special online price on the basis of the accuracy of the information provided by Client. If information provided by Client is incorrect, Client agrees to pay Attorney's hourly fee of $295 per hour for any additional work required to prepare and handle Client's case. Failure to promptly make the additional payment constitutes breach of contract, automatic forfeiture of the initial amount paid by Client, and relieves Attorney of any and all further duties owed to Client. 10. This is Our Complete Agreement: Client acknowledges and agrees that Attorney's services are retained solely with regard to the specific legal services described in this agreement. Attorney is not undertaking to represent Client on appeal, or for any other reason. This agreement expresses the full and complete understanding between Attorney and Client, unless later amended in writing and signed by both parties. 11. Jurisdiction: Jurisdiction and venue for any dispute between Client and Attorney shall be exclusively held in Yolo County in the State of California. 12. Execution of Agreement: This agreement is effective when Client makes agrees to these terms and makes his or her payment as described herein. Upon receipt of this payment, Attorney will begin to prepare the necessary petitions, motions, and professional work product necessary for Client's case. Attorney will make a good faith effort to file Client's case as soon as possible after being retained. This agreement is executed in duplicate, the receipt of a copy of which is hereby acknowledged by the undersigned. By retaining Attorney, Client attests that he or she has read all of the above, understands it, and agrees to it. INFORMATION ABOUT CALIFORNIA EXPUNGEMENTS What is an "Expungement?" California law currently provides a special procedure for expunging criminal convictions if particular criteria have been satisfied. What actually occurs is that your plea of guilty (or no contest) or the verdict of guilt is withdrawn, a plea of not guilty is entered in its place, and the Court then dismisses your case. The record of your conviction is marked as "DISMISSED," "dismissed in the furtherance of justice" or "dismissed pursuant to PC 1203.4 (or 1203.4a)." What an Expungement Does: > You can answer "No" on a job application if a private employer asks you if you've ever been convicted of a crime. (See below for certain government employers). > An Expungement can help you with some job licenses and certificates. (Contact the specific licensing body to determine whether an expungement will help). > An Expungement can help you with housing and loan applications. > If you are ineligible for federal student loans because of drug convictions, you will have your eligibility restored. What an Expungement Does Not Do: > If you are charged with another crime in the future, the expunged conviction can still be used as a prior conviction to increase your sentence. If the expunged conviction was a "strike," it will still count as a strike. > Expunging your conviction will not restore your ability to possess a firearm. > If you have to register as a sex offender, you will still have to register even after the conviction is expunged. > Some government and professional licensing agencies do not recognize expungements when determining whether to grant or deny a license. An expungement will never hurt your situation and will often help, but you should contact the specific licensing organization to determine whether an expungement will help your particular situation. > If applying for public (i.e., government) employment, or a contract with the state lottery, you must still admit the expunged conviction if asked whether you have ever been convicted, but you can (and should) note that it has been expunged. > If your driver's license has been suspended, expungement of the conviction will not affect your license; it will still be suspended.
