Here's exactly what we do: We go to court, re-open your old criminal case, and ask the judge to withdraw your old plea of guilty (or no contest), and enter a new plea of NOT GUILTY. We then ask the judge to DISMISS your case. This is known as an "expungement."
The Result: Once your conviction is expunged, you can lawfully answer that you have never been convicted of the crime. For government jobs, licenses, and law enforcement questions, you will need to disclose the case, but you can note: "Case Expunged Pursuant to California Penal Code, section 1203.4."
How long does it take? In most cases our law firm can file your expungement petition in court within 3 or 4 days of obtaining your case information. The judge usually holds a hearing about 45 days after we file. Of course, these times vary from expungement to expungement and from court to court.
