The Law Firm of Richard Glen Boire
specializes in the defense of drug cases, especially those that involve
relatively esoteric plants like Catha edulis (aka Khat, Quat, Qat).
Richard Glen Boire was the first attorney
in the United States (and in the world as far as we know) to publish legal
arguments concerning the important legal distinctions between Khat plants
and their active principles cathinone and cathine. (See, 1 The Entheogen
Law Reporter 1-6 (Winter 1993), followed by 7 The Entheogen Law Reporter
59-68 (Summer 1995).)
While cathinone and cathine have been
placed in Schedule I and IV of the federal controlled substances act,
Catha edulis, the plant that endogenously produces these phytochemicals,
has never been expressly scheduled.
According
to the DEA, the plant is illegal because it is a "mixture" that
contains one or both of these scheduled substances.
